About these terms

These Terms of Service apply to your use of the Rising Heights ABA website and, if you separately opt in, our SMS/MMS text messaging program. “Rising Heights ABA,” “we,” “us,” and “our” refer to our New Mexico ABA practice. By using the website, you agree to these website terms. If you do not agree, please discontinue use.

Website use does not enroll you in text messaging. Text communications require separate consent. Clinical services, financial responsibilities, and treatment consent are governed by the separate agreements and notices provided in connection with care.

Website information and care

Information on this website is for general educational and informational purposes. It is not individualized clinical advice, a diagnosis, or a treatment plan. Visiting the website, making an inquiry, or exchanging a text message does not by itself establish a provider-patient relationship or guarantee enrollment or availability.

Care recommendations require an appropriate professional evaluation. Service availability, insurance participation, benefits, and authorization requirements must be confirmed with our team and the relevant health plan. Website descriptions do not guarantee coverage, payment, or a particular treatment outcome.

This website, email, and text messaging are not emergency services and are not continuously monitored. Call 911 for an emergency. Contact your treating professional through the appropriate care channel for clinical concerns.

SMS/MMS messaging terms

Program and purpose

Rising Heights ABA offers optional text communications for intake follow-ups, appointment reminders, scheduling updates, and customer support. Messages are sent through our communications provider, Zoom. This program is not used for promotional texts.

Consent and eligibility

You must be at least 18 and authorized to use the mobile number you provide. You may opt in by entering your mobile number in our intake form and selecting the separate SMS checkbox, which is optional and unchecked by default. We record that choice and the consent wording with your inquiry. Simply supplying a number, submitting an inquiry without checking the SMS box, or using this website is not consent to ongoing texting. Agree only for a number you control, and tell us if that number changes. You may choose another communication method. Consent is not a condition of purchasing or receiving services.

Frequency and charges

Message frequency varies with your appointments, intake needs, and conversations. Message and data rates may apply under your carrier’s plan.

Opting out and getting help

Reply STOP to any program message to unsubscribe. We may send a single confirmation, after which program messages will stop unless you opt in again. Reply HELP for assistance. You can also call (505) 407-6700 or email intake@risingheightsaba.com. Opting out of texts does not cancel an appointment or end care; contact our team separately about those matters.

Delivery and privacy

Delivery depends on carriers, networks, and your device. Messages may be delayed or unavailable. Carriers are not liable for delayed or undelivered messages. Do not rely on text messages for emergencies or time-critical clinical needs, and do not send detailed medical records through ordinary SMS/MMS.

Your mobile information and messaging consent are not sold or shared for third-party or affiliate marketing or lead generation. Limited processing to deliver messages on our behalf is explained in our Privacy Policy.

Using the website respectfully

You may use the website for lawful personal purposes, including learning about our services and contacting our team. Please provide accurate information and share information about someone else only when you have appropriate authority.

Do not use the website to harass others, submit unlawful material, impersonate someone, introduce malicious code, interfere with security or availability, or attempt to access information without authorization.

Content and third-party links

The website’s branding, text, design, and artwork belong to Rising Heights ABA or their respective rights holders. You may view and print information for personal, noncommercial use without removing ownership notices. Other reproduction or use requires permission unless allowed by law.

Third-party links are provided for convenience. We do not control independently operated websites or their content, availability, or terms. A link does not by itself establish an endorsement or guarantee.

Availability and limitations

We aim to keep website information helpful and current, but errors, omissions, and interruptions may occur. The website is provided as available, without a guarantee of uninterrupted access or that every item will remain current. Please confirm important details directly with our team.

These terms govern website use and routine messaging, not the standard of clinical care. Nothing in these terms excludes responsibilities that cannot lawfully be excluded or limits your patient, privacy, or consumer rights under applicable law.

Changes and applicable law

We may update these terms or the website. Revised terms will display an updated date, and changes apply prospectively. We will obtain additional messaging consent when required rather than treating a website visit as consent to new message types.

New Mexico law and applicable federal law govern these terms, subject to any mandatory protections that apply to you. If a provision cannot be enforced, the remaining provisions continue to apply to the extent allowed by law.
